Liability Waiver 2021
By signing up to be a member The University of Auckland Kitesurf Club (The Club) I understand and accept the following:
-
I accept that kitesurfing is a dangerous activity which carries inherent and obvious risks that can lead to injury and in some cases, death.
-
I understand and accept that I am responsible for my own safety when engaging in any kitesurf related, or Club related activities.
-
I understand and accept that The Club is a voluntary organisation, and it’s convenors, and other governing members are volunteers and have no obligations under the Health and Safety at Work Act 2015.
-
I understand and accept that I rely on the advice of The Club, it’s governing bodies, and other members at my own risk.
-
I accept that The Club, it’s governing bodies, and other members, accept no liability to any party for any personal injury or death that may result from engaging in any kitesurf related activities.
-
I accept that The Club, it’s governing bodies and other members accept no liability for damage to any equipment or property whether it be owned by The Club, or another party, or any consequential loss relating to that damage.
-
I accept that The University of Auckland and the University of Auckland Kitesurf Club are separate entities and that The University of Auckland also accepts no liability for any personal injury, losses, or claims for damages or other compensation that may result from kitesurfing or Club related activities.
-
I understand and accept that The Club accepts no liability or responsibility for any losses or damages or other compensation however arising out of, or in relation to, my membership of The Club or participation in any kitesurf related activity. This applies regardless of any negligence or tortious act or omission on the part of The Club, its governing bodies, or members. To the full extent permitted by law, I waive all legal rights against The Club, it’s convenors, and governing bodies in this regard.
